The situations I have in mind are familiar ones. If a defendant uses a plaintiff’s dock to save his ship in a storm, the defendant will be liable to compensate her for the resulting damage, although the trespass was entirely reasonable.262 If a defendant reasonably decides to conduct some ultrahazardous blasting in order to demolish an abandoned shack and build a new house on her land, and foreseeably ends up injuring her neighbor as a result, the neighbor will be able to recover.263 If a defendant runs a small business, and hires and trains a new employee who negligently causes a customer to suffer harm a few weeks into the job, the defendant will be liable to the customer even if she cannot be accused of any fault in hiring, training, or supervising the employee.264 The doctrines that secure recovery in these cases are familiar features of tort law.
